1. Who we are

HomeEQ (“HomeEQ”, “we”, “us”) is operated by HomeEQ Technologies Private Limited, Pune, India. These Terms govern your use of the HomeEQ website and app.

2. The platform

HomeEQ connects material brands, dealers/distributors, architects, designers, developers, contractors and homeowners for material discovery, sampling, and sourcing. HomeEQ is not a manufacturer, dealer, or logistics provider. Transactions for the purchase of materials are between the buyer and the relevant dealer or distributor; HomeEQ facilitates discovery, attribution, and, where applicable, a Referral Fee to the referring professional.

3. Accounts

You are responsible for the accuracy of information you provide and for activity under your account. Professional and business accounts (brand, dealer/distributor) are subject to HomeEQ’s verification before being listed publicly.

4. Orders and payments

Where an order is placed through the platform, the seller of record is the dealer or distributor fulfilling that order, not HomeEQ. Payment is collected by the seller through their own payment provider. HomeEQ records order, payment status, and fulfilment information for the purpose of operating the platform, and does not hold buyer funds.

5. Referral Fees

Where a professional recommends a material and a client subsequently orders it through HomeEQ, a Referral Fee may become payable by the fulfilling dealer, on terms set out in that dealer’s or brand’s referral programme.

6. Content and data

Material specifications, images and certifications are provided by brands and are their responsibility. HomeEQ does not independently verify every claim and disclaims liability for inaccuracies in third-party content, without prejudice to any verification badges displayed on the platform.

7. Prohibited use

You may not use HomeEQ to submit false information, circumvent attribution or fees owed to another party, scrape or resell platform data, or interfere with the security or normal operation of the platform.

8. Liability

HomeEQ is provided “as is”. To the maximum extent permitted by law, HomeEQ is not liable for disputes between buyers and dealers, delivery delays, or losses arising from reliance on third-party product data.

9. Governing law

These Terms are governed by the laws of India, with courts in Pune, Maharashtra having exclusive jurisdiction.
